Just weeks after restaurateur Octavio Diaz settled a federal Department of Labor lawsuit for more than $80,000 over wage theft from employees, a new class action suit has been filed against him.
Several employees filed suit in Sonoma County Superior Court claiming additional wage theft from unpaid tips, improper timesheet accounting including forcing employees to miss breaks and verbal intimidation, all according to the Press Democrat. Diaz owns Agave and Gallina D’Oro in Healdsburg, El Farolito in Windsor and Mitote Food Park.
